Despite the increasingly diversified discourses in international commercial arbitration, this device of socio-legal regulation remains a relatively under-theorized subject. In particular, far too little attention has been paid to analyzing international commercial arbitration through critical approaches such as Third World Approaches to International Law (TWAIL). TWAIL is broadly understood as a methodological reorientation in international law by highlighting the historical links between the foundations of this field of law and the history of capitalism and imperialism as well as the colonial (...) and Eurocentric legacies in the structure and operation of the current international legal regime. With this in mind, two fronts in international commercial arbitration invite a reexamination through a TWAIL perspective and by drawing on the concept of hegemony. One front is the transnational account of arbitration, and the other one is the epistemic community of arbitration. By examining these two notions through a narrative of hegemony of Western legal traditions, we posit that any effective attempt at redefining or reforming arbitral governance structure towards sustaining diversity requires a deeper understanding of historical and current world power structures and creating a vision for the prospect of dehegemonization. Mansour Fahmy, one of the dramatic figures in modern Arab philosophical and social thought. He was the reformist and enlightenment figure in modern Arab history. He is also the owner of a notable current that was subjected to a violent attack that silenced him for a long time and forced him to "hide" physically. However, this did not eliminate the new opinions and positions that came at the beginning of the twentieth century towards the issue of women. He is (...) the first to write with a scientific methodology - from the point of view of sociology - on Islamic discourse and its dealings with women. he sought to differentiate between religion and the religious establishment, between the personality of the Prophet Muhammad and what later prevailed in the books of jurisprudence and others. When he discussed the headscarf issue, he concluded that it was the product of traditions and customs that the Hijab is not from the Islamic religion. Islamic law has nothing to do with the Hijab. Mansour Fahmy's creativity was at one of the sensitive stages in Egypt's modern history in which the political, social, national, cultural, and revolution clashed in each one. All this, in turn, identified the problem of Mansour Fahmy's intellectual personality in the battles of thought and politics. This research's main task is to redraw the features of his actual personality and the reality of his intellectual, social, and political positions. Besides, this study seeks to uncover the effect of philosophy on crystallizing Mansour Fahmy's critical personality and its role in laying the foundations of the critical vision with its practical, reformist, and enlightening dimensions. In many areas, technology has facilitated many things, diagnosing diseases, regulating traffic and teaching students in schools rely on Intelligent systems to name a few. This study describes intelligent tutoring system for teaching the Data Manipulation Language (DML) Commands Using SQLite to non IT students to overcome the difficulties they face. The System was built as education system by using the researcher own authoring tool that based on mobile and web App. The basic idea of this system is a systematic introduction into the concept of Database and its DML query. The system presents the topic of DML Commands, help student to execute what they are learn from the system content using the practical part of the system and administers automatically adapted at run time to the student’s individual growth. The system was assessed by a group of teachers and students and the outcome showed as 91% from the database specialists, 94% from Diploma students group and 89% from the secondary school students group. Compassion, as an indicator for quality care, is highly valued by patients and healthcare professionals. Compassionate care is considered a moral dimension of nursing practice and an essential component of high quality care. This study aimed to answer these questions: What are the facilitators and barriers of providing compassionate nursing care in the clinical setting? Which strategies do nurses use to provide compassionate care? What is the specific model of compassionate care for the nursing context? A grounded theory approach was (...) used in this study. A total of 21 nurses working in diverse clinical settings participated in the study. Purposive and theoretical sampling was used to select the participants. Data were collected by in-depth face to face interviews and analyzed by the constant comparative method. Ethical approval was gained from the Ethical Review Board of Tabriz University of Medical sciences. The analysis resulted in the development of three main themes: contextual factors affecting compassionate care, the compassionate care actions, and the consequences of compassionate care. The main dimensions of compassionate care are demonstrated in a Compassionate Nursing Care Model. Nurses’ ability on providing compassionate care is influenced by individual and organizational factors that may facilitate or inhibit this type of care. Leadership and nurse managers should remove the barriers which diminish the nurses’ ability to provide compassionate care and support them to engage in compassionate care programs. Identifying and recruiting compassionate nurses, developing their compassionate capacity, and providing role models of compassion could improve the flourishing of person-centered and compassionate care in clinical settings. Background: Dengue Disease is a mosquito-borne tropical disease caused by the dengue virus, symptoms typically begin three to fourteen days after infection. This may include a high fever, headache, vomiting, muscle and joint pains, and a characteristic skin rash. Dengue serology is applied in different settings, such as for surveillance, in health care facilities in endemic areas and in travel clinics in non-endemic areas. The applicability and quality of serological tests in dengue endemic regions has to be judged against a (...) background of potential cross reactivity with other flavi-viruses, difficulties in distinguishing primary from secondary infections and technological problems related to the fact that most dengue endemic regions are relatively poor of resources .Objectives: to help doctors and patients in diagnosing Dengue Disease and give them the information of how to prevent Dengue Disease and to be able to understand the signs and symptoms of Dengue Disease. Methods: We collected all relevant material for Dengue Disease. Then we designed and implemented a knowledge based system for diagnosing Dengue Disease using SL5 Object Language. This paper is based on review of the publications of the Islamic Movement and interviews with its leadership and activists. It argues that the Movement’s resistance to the 1948, 1967 and diasporic dismemberment of Palestine has constituted a critical challenge to Israeli policies, and contributed to reframing the internal Israeli political discourse. That is what led to its being banned by the state. The Islamic Movement was established in the 1970s. It remains, despite its split in 1996 into Northern and (...) Southern branches, a key player in Palestinian minority affairs at the political level, and at the social level through service provision to the marginalized Arab communities, especially in East Jerusalem. In 2015, the Israeli cabinet declared the Northern branch illegal and withdrew its status as a recognized organization. The findings of this paper show that this measure is directly linked to the Movement’s effectiveness in resisting the dispossession of the Palestinians, in advocating their right of return and other human rights, in providing leadership in the struggle over East Jerusalem, and in the organization and delivery of humanitarian services. In this paper, we present a deterministic time discrete mathematical model based on multiregional periodic matrices to describe the dynamics of Sardina pilchardus in the Central Atlantic area of the Moroccan coast. This model deals with two stages (immature and mature) and three spatial zones where sardines are supposed to migrate from one zone to another. The population dynamics is described by an autonomous recurrence equation N(t + 1) = A.N(t), where A is a positive matrix whose entries are estimated (...) using data collected during biannual acoustic surveys carried out from 2001 to 2003 onboard the Norwegian research vessel “Dr Fridtjof Nansen”. The dominant eigenvalue λ of A that gives the long-term growth rate of fish population is smaller than one. This agrees with the stock decrease observed in the data collected. We show that λ is highly sensitive to the recruitment rate and much less sensitive to the reproduction rate. These results can clearly be used to define an efficient scenario in order to fight for instance against a stock decrease. (shrink)

Physicist Percy Bridgman has been taken by Heather Douglas to be an exemplar defender of an untenable value-free ideal for science. This picture is complicated by a detailed study of Bridgman's philosophical views of the relation between science and society. The normative autonomy of science, a version of the value-free ideal, is defended. This restriction on the provenance of permissible values in science is given a basis in Bridgman's broader philosophical commitments, most importantly, his view that science is primarily an (...) individual commitment to a set of epistemic norms and values. Considerations of external moral or social values are not, on this view, intrinsic to scientific practice, though they have a broader pragmatic significance. What Bridgman takes as the proper relation between science and society is shown through analysis of his many writings on the topic and consideration of his rarely remarked upon involvement in the most problematic example of "Big Science" of his day: the atomic bomb. A reevaluation of Bridgman's views provides a unique characterization of what is at stake in the values in science debate: the normative autonomy of science. (shrink)

Ubuntu has been defined as a moral quality of human beings, as a philosophy or an ethic, as African humanism, and as a worldview. This paper explores these definitions as conceptual tools for understanding the cultural, educational, and philosophical landscape of post-apartheid South Africa. Key to this understanding is the Althusserian concept of state apparatus. Louis Althusser divides the state apparatus into two forces: the repressive state apparatus (RSA); and the ideological state apparatus (ISA). RSAs curtail the working classes, predominately (...) through direct violence or the threat of violence, whereas ISAs function primarily by ideology, including forms of organised religion, the education system, family units, legal systems, trade unions, political parties, and media. This paper discusses the link between increasing inequality in post-apartheid South Africa and education, with specific reference to Althusser’s ISAs and the abuse of Ubuntu as a subterfuge for socio-economic inequality. This book explores the spiritual potential of faith, mysticism and transcendence in answer to the dangers of a mythologised state and the sacro-sanctification of (liberal) democracy and its rule of law. The production of genetically modified crops is growing around the world, and with it possible opportunities to combat food insecurity and hunger, as well as solutions to current problems facing conventional agriculture. In this regard the use of GMOs in food and agricultural applications has increased greatly over the past decade. However, the development of GM crops has been a matter of considerable interest and worldwide public controversy. This, in addition to skepticism, has stifled the use of this practice on (...) a large scale in many areas, including Iran. It stands to reason that a greater understanding of this practice could be formed after a review of the existing expert opinions surrounding GM crops. Therefore, the purpose of this study was to analyze the predictors that influence agricultural experts’ attitudes toward the development of and policies related to GM crops. Using a descriptive correlational research method, questionnaire data was collected from 65 experts from the Agricultural Organization in the Gotvand district in Southwest Iran. Results indicated that agricultural experts were aware of the environmental benefits and possible risks associated with GM crops. The majority of participants agreed that GM crops could improve food security and accelerate rural development, and were proponents of labeling practices for GM crops. Finally, there was a positive correlation between the perception of benefits and attitudes towards GM crops. (shrink)

Studies and scientific studies have proven the importance of eating tomato juice in reducing the activity of platelets in diabetics, which (...) helps in protecting them from developing deadly blood clots. A tomato classification approach is presented with a data set containing approximately 5,266 images with 7 species belonging to tomatoes. Sociolinguistics—or the sociology of language—provides such an approach and can help to shed new light on a phenomenon which is often discussed in terms that tend to create more problems than they solve. The quality of the products coming from different lines of production requires some tests called comparative life tests. For lines having the same facility, the lifetime of the product is distributed by Burr XII, the lifetime distribution, and units are tested under type-I generalized hybrid censoring scheme. The observed censoring data are used under maximum likelihood and the Bayes method to estimate the model parameters. Objectivity is one of the most basic and difficult issues in modern and contemporary philosophy. The present paper is devoted to this issue from view- point of Husserl’s transcendental phenomenology. Since perception, particularly sense perception, in view of intentionality, as lowest level of objectivity can act as the base for perceiving the objectivity of other objects, whether real or unreal, it has been discussed in this paper. To do this, objectivity of the sense perception and its role in leading the (...) mind toward essential and ideal objects, and conversely, the role of latter objects in objectivity of the perception itself will be explored. Because the concepts of objectivity and evidence are correlate in Husserl’s philosophy, and since evidence as the self-given manifests itself, from the very beginning, in the lowest level, namely the objects of sense perception, and considering that evidence and objectivity of sense perception concern this lowest level, the critical viewpoint of Husserl’s phenomenology provides a firm and new basis for objectivity if taken at its full competence. This article exploits the synergy of critical discourse studies and Corpus Linguistics to study the pervasive representation of Islam and Muslims in an approximate 670,000-word corpus of US news media stories published between 2001 and 2015. Following collocation and concordance analysis of the most frequent topics or categories which revolve around the representation of Islam and Muslims in US news stories, the Discourse-Historical Approach to critical discourse analysis was adopted to investigate how the discursive strategies of nomination and predication are (...) used in US news media stories. The findings indicated that, in general, Islam and Muslims are associated with violence, religious radicalism, and Islamic extremist militants. Finally, the article discusses the discursive themes resulting from the analysis of personal pronouns as well as the educational implications of the findings for social studies and multicultural education. One of the main arguments intended to show that content externalism undermines the privileged access thesis is the ‘slow switching argument’, originally proposed by Boghossian. In this argument, it is supposed that a subject is unknowingly switched back and forth between Earth and Twin Earth: then it is claimed that, given externalism, when the subject is on Earth thinking that water is wet, he cannot know the content of his thought a priori, for he cannot, by mere reflection, rule out (...) the relevant alternative hypothesis that he is on Twin Earth thinking that twater is wet. One of the controversies surrounding this argument stems from the fact that it is not clear which epistemological principle underlies it. Here, I examine two suggestions made in the literature as to what that underlying principle might be. I argue that neither of these suggested principles is plausible, and thus that the slow switching argument never gets off the ground. (shrink)

In this paper a symmetry argument against quantity absolutism is amended. Rather than arguing against the fundamentality of intrinsic quantities on the basis of transformations of basic quantities, a class of symmetries defined by the Π-theorem is used. This theorem is a fundamental result of dimensional analysis and shows that all unit-invariant equations which adequately represent physical systems can be put into the form of a function of dimensionless quantities. Quantity transformations that leave those dimensionless quantities invariant are empirical and (...) dynamical symmetries. The proposed symmetries of the original argument fail to be both dynamical and empirical symmetries and are open to counterexamples. The amendment of the original argument requires consideration of the relationships between quantity dimensions. The discussion raises a pertinent issue: what is the modal status of the constants of nature which figure in the laws? Two positions, constant necessitism and constant contingentism, are introduced and their relationships to absolutism and comparativism undergo preliminary investigation. It is argued that the absolutist can only reject the amended symmetry argument by accepting constant necessitism. I argue that the truth of an epistemically open empirical hypothesis would make the acceptance of constant necessitism costly: together they entail that the facts are nomically necessary. (shrink)

Given the evolution of the public health (PH) and the changes from the phenomenon of globalization, this area has encountered new ethical challenges. In order to find a coherent approach to address ethical issues in PH policy, this study aimed to identify the evolution of public health ethics (PHE) frameworks and the main moral values and norms in PH practice and policy. According to the research questions, a systematic search of the literature, in English, with no time limit was performed (...) using the main keywords in databases Web of Science (ISI) and PubMed. Finally, the full text of 56 papers was analyzed. Most of the frameworks have common underpinning assumptions and beliefs, and the need to balance PH moral obligation to prevent harm and health promotion with respect for individual autonomy has been specified. As such, a clear shift from liberal values in biomedical ethics is seen toward the community’s collective values in PHE. The main moral norms in PH practice and policy included protecting the population against harm and improving PH benefits, utility and evidenced-based effectiveness, distributive justice and fairness, respect for all, privacy and confidentiality, solidarity, social responsibility, community empowerment and participation, transparency, accountability and trust. Systematic review of PHE frameworks indicates utilization of the aforementioned moral norms through an practical framework as an ethical guide for action in the PH policy. The validity of this process requires a systematic approach including procedural conditions. (shrink)

As future citizens, students must make decisions requiring an understanding of the interaction of science and technology and its interface with society. STS education has been strongly identified with meeting this goal, but putting theory into practice has so far been difficult. This article asks, “What are the challenges influencing science teachers to implement STS education in the science classroom?” The author investigated using a mixed method research technique incorporating multiple sources of qualitative and quantitative data (questionnaire, interviews, field notes, (...) and classroom observations). Constraints a fecting teachers' practices in teaching science through STS education were identified and can be categorized into impersonal, interpersonal, and personal constraints. Norms provide a valuable mechanism for establishing coherent cooperative behaviour in decentralised systems in which there is no central authority. One of the most influential formulations of norm emergence was proposed by Axelrod :1095–1111, 1986). This paper provides an empirical analysis of aspects of Axelrod’s approach, by exploring some of the key assumptions made in previous evaluations of the model. We explore the dynamics of norm emergence and the occurrence of norm collapse when applying the model over extended durations. It (...) is this phenomenon of norm collapse that can motivate the emergence of a central authority to enforce laws and so preserve the norms, rather than relying on individuals to punish defection. Our findings identify characteristics that significantly influence norm establishment using Axelrod’s formulation, but are likely to be of importance for norm establishment more generally. Moreover, Axelrod’s model suffers from significant limitations in assuming that private strategies of individuals are available to others, and that agents are omniscient in being aware of all norm violations and punishments. Because this is an unreasonable expectation, the approach does not lend itself to modelling real-world systems such as online networks or electronic markets. In response, the paper proposes alternatives to Axelrod’s model, by replacing the evolutionary approach, enabling agents to learn, and by restricting the metapunishment of agents to cases where the original defection is observed, in order to be able to apply the model to real-world domains. This work can also help explain the formation of a “social contract” to legitimate enforcement by a central authority. (shrink)

From the ancient Egyptian tale of a Shipwrecked Sailor through to Sinbad and Robinson Crusoe, the stranded castaway living and philosophizing alone on a strange, desert island is a theme which has captured the imaginations of writers spanning cultures and millennia. Most familiar to Western literary historians is Daniel Defoe’s Robinson Crusoe, which inspired generations of writers from Jonathan Wyss and William Golding to Michel Tournier and J.M.Coetzee. However, little attention has been paid to Defoe’s antecedents, such as the remarkable (...) HayyIbn Yaqzan by twelfth-century Arab physician and philosopher, Muhammad Ibn Tufayl. Mahmoud Baroud here conducts a detailed comparative textual analysis of Hayy Ibn Yaqzan and Robinson Crusoe, and concludes that Daniel Defoe was likely to have been deeply influenced by Ibn Tufayl’s Arabic text. I provide an account of the physical appropriate to the task of the physicalist while remaining faithful to the usage of “physical” natural to physicists. Physicalism is the thesis that everything in the world is physical, or reducible to the physical. I presuppose that some version of this position is a live epistemic possibility. The physicalist is confronted with Hempel’s dilemma: that physicalism is either false or contentless. The proposed account of the physical avoids both horns and generalizes a recent (...) proposal by Vicente (2011). My account defines physicalism as the thesis that there are no objects that cannot be described by physical quantities. BackgroundBetween the need for transparency in healthcare, widely promoted by patient’s safety campaigns, and the fear of negative consequences and malpractice threats, physicians face challenging decisions on whether or not disclosing medical errors to patients and families is a valid option.We aim to assess the knowledge, attitudes and practices (KAP) of physicians in our center regarding medical error disclosure.MethodsThis is a cross-sectional self-administered questionnaire study. The questionnaire was piloted and no major modifications were made.A day-long training workshop consisting of didactic (...) lectures, short and long case scenarios with role playing and feedback from the instructors, were conducted. Physicians who attended these training workshops were invited to complete the questionnaire at the end of the training, and physicians who did not attend any training were sent a copy of the questionnaire to their offices to complete. To assure anonymity and transparency of responses, we did not query names or departments.Descriptive statistics were used to present demographics and KAP. The differences between response\s of physicians who received the training and those who did not were analyzed with t-test and descriptive statistics. The 0.05 level of significance was used as a cutoff measure for statistical significance.ResultsEighty-eight physicians completed the questionnaire (55 attended training (62.50%), and 33 did not (37.50%)). Sixty Five percent of physicians were males and the mean number of years of experience was 16.5 years. Eighty-Seven percent (n = 73) of physicians were more likely to report major harm, compared to minor harm or no harm. Physicians who attended the workshop were more knowledgeable of articles of Jordan’s Law on Medical and Health Liability (66.7% vs 45.5%,p-value = 0.017) and the Law was more likely to affect their decision on error disclosure (61.8% vs 36.4%,p-value = 0.024).ConclusionFormal training workshops on disclosing medical errors have the power to positively influence physicians’ KAP toward disclosing medical errors to patients and possibly promoting a culture of transparency in the health care system. The question of whether females tend to act more ethically or risk-averse compared to males is an interesting ethical puzzle. Using a large sample of US firms over the 1992–2014 period, we investigate the effect that the gender of a chief executive officer has on earnings management using classification shifting. We find that the pre-Sarbanes–Oxley Act period was characterized by high levels of classification shifting by both female and male CEOs, but the magnitude of such practices is, surprisingly, significantly higher (...) in firms with female CEOs than in those with male CEOs. By contrast, our results suggest that following the passage of the punitive SOX Act, classification shifting by female CEOs declined significantly, whilst it remained pervasive in firms with male CEOs. This suggests that the observable differences in financial reporting behavior between male and female CEOs seem to be because female CEOs are more risk-averse, but not necessarily more ethically sensitive than their male counterparts are. The central tenets of our findings remain unchanged after several additional checks, including controlling for alternative earnings management techniques, corporate governance mechanisms, CEO and chief financial officer characteristics and propensity score-matching. The paper deals with the study of the existence of weak positive solutions for a new class of the system of elliptic differential equations with respect to the symmetry conditions and the right hand side which has been defined as multiplication of two separate functions by using the sub-supersolutions method.

This dissertation draws upon historical studies of scientific practice and contemporary issues in the metaphysics and epistemology of science to account for the nature of physical quantities. My dissertation applies this integrated HPS approach to dimensional analysis—a logic for quantitative physical equations which respects the distinct dimensions of quantities (e.g. mass, length, charge). Dimensional analysis and its historical development serve both as subjects of study and as a sources for solutions to contemporary problems. Along the lines of a previous work, the geometrical structure of Hibert bundles describing extended quantum free particles is repeated with Galilei external and internal independent symmetries. Then, in order to introduce the interaction, this structure is extended by replacing configuration and momentum spaces by the socelled spaces of trajectories and extended velocity boosts, respectively. These provide representations giving the probability amplitudes for the particle to follow certain trajectories. The interaction can be introduced in the transformation law from functions on (...) the space of trajectories (free dynamics) to functions on spacetime (intracting dynamics). This transformation law, which makes use of a universal distribution, is seen as a functional in our work according to a quantum functional theory which generalizes the ideas of de Broglie. Intertwining of induced representations gives the free propagator in the space of trajectories and, henceforth, the propagator with interaction in space-time for the extended particle. (shrink)
